Judge Deems Sex Tape of Waffle House Chairman an Invasion of Privacy

The chairman's lawyers say the entire case is a setup.

The former housekeeper of Buckhead resident and Waffle House Chairman Joe Rogers may have violated his privacy by videotaping their sexual encounters, according to a ruling from one Cobb County Superior Court judge.

Mye Brindle, who worked for Rogers as a part-time housekeeper and house manager from 2003 to 2012, has accused Rogers of fondling her and forcing her to engage in sex acts.

Rogers admits to having a consensual affair with his former housekeeper, but said he did not sexually harass her. He has stated that the claims are attempts to extort millions of dollars from him.

Rogers' attorneys hope the ruling means Brindle's sexual abuse case can be dismissed.

According to the Marietta Daily Journal, Cobb County Superior Court Judge Robert Leonard learned that in July 2012, Brindle was sent to a private investigator by her lawyers. The investigator ordered a "spy camera," which was used to make videos in Rogers' bedroom without his consent.

The video showed that Brindle was a willing participant in the sexual encounter and isn't a sexual battery victim, stated an unspecified order referred to by the MDJ.

The newspaper report states that Brindle also made 15 audio recordings of their sexual encounters and kept a towel with her boss' DNA on it.

Rogers' lawyers are calling the case a "setup," and are adding Brindle's lawyers as defendents in their client's case. Rogers' lawyers may file a motion to disqualify Butters and Cohen if they don't voluntarily step down.

Brindle will now be required to answer questions about the videotape during an hourlong deposition at a later date.
