Oscar Winner Reese Witherspoon Arrested in Buckhead

The Nashville, Tenn. native was arrested for disorderly conduct, and her husband was arrested on a DUI charge.

Reese Witherspoon, the Academy Award-winning actress, was arrested in Buckhead on a charge of disorderly conduct just after midnight Friday, but was posing on the red carpet on Sunday night at the premiere of her new film "Mud."

A Georgia State Trooper stopped the 2013 Ford Fusion near Peachtree Road and Peachtree Battle Avenue because it was not staying in its lane. The car was being driven by Witherspoon's husband, James Toth.

According to the incident report, Toth had droopy eyelids and bloodshot, watery eyes and his breath smelled of alcohol.

The trooper J. Pyland asked Toth how much he'd had to drink. Toth and Witherspoon responded that he'd had a drink two hours earlier at a restaurant.

Toth agreed to a sobriety test and was directed to back his car into the nearby Walgreens.

Before Toth performed the field sobriety test, Witherspoon tried to get out of the car. The trooper told her to remain in the vehicle.

Then several times after that, the trooper had to tell Witherspoon to remain in the car and that she would be arrested if she got out again, according to the report.

Pyland wrote that after he administered the field sobriety test, "Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer. I told Mrs. Witherspoon to sit on her butt and be quiet."

After Toth was placed under arrest and charged with driving under the influence, Witherspoon got out of the car again and walked up to the trooper and Toth.

She asked what was going on, and Pyland told her Toth was under arrest and asked her to get back into the vehicle.

To which she replied that she was a "U.S. citizen" who had a right to "stand on American ground."

According to his report, Pyland arrested Witherspoon, who asked him if he knew her name. He said he didn't need to know her name right then. She said, "You're about to find out who I am."

The report indicates that later as the trooper took her from one side of the back of the patrol car to the other, she told him her name and said "You're going to be on national news."

Both Toth and Witherspoon were taken to jail.
